November 2005 and she is filing suit in November 2008; three years later? Yeah that's bound to be because she has a genuine claim and not because some bills cropped up or she wants a new car or some shit.

Like Chris my cop friend says, take a handful of harden the !@#$ up and get over it.

While this case may indeed be frivolous, we do not know all the details and can not be sure. I do agree, we sue way too much over bullshit, but this could quite possibly be a legitimate claim.

The reason I say that is because it is actually a motion being filed three years after the fact which means she may have had surgery, pins, rehab, any and all of the above. Technically, unless a settlement is made quickly and out of court, one can not start the actual lawsuit process through the courts UNTIL you have completed ALL treatments for that injury and recovered 100% or until such time it is determined you have reached maximum recovery. It is at that time all bills are calculated and a settlement is proposed to cover those bills, lost wages, future loss of function or employment, etc, etc. Dustdevil can account to this process I am sure.

Maybe she should sue the restaraunt too for letting someone get sick in their bathroom.

Have you guys gone nuts? Perhaps she was genuinely injured. Maybe the bag was placed just behind her. Then the partner says move and gives a gentle shove or "accidentally" bumps her. She falls, breaks wrist, has multiple surgerys, loses wages, etc. She really does not want to sue but with the medical bills piling up she finally files for actual medical bills so she can avoid bankruptcy. The more I type the more I think she should have gone for millions. Come on guys we can not make up our minds knowing so little facts. $100,000 is not really a whole lot to ask if she lost work time, had surgerys etc. I spent 4 nights in the hospital and it was over $24000 and they did nothing for me. If she actually needed any real care or even physical therapy medical expenses over 3 years pile up quick. Just saying don't be so one sided. Play nice now.

Another case in point...an off duty EMT/paramedic student comes upon an accident close to her home. Rescue arrives and begins extrication. They ask her to get out of the way, but the ambulance crew (not associated with rescue and not the service she works for) tells her to stay there. A chain snaps while removing the roof of the car and injures her hand. She is now suing fire/rescue but not the ambulance service. The best part is she is claiming disability yet continues to play softball and racketball.

This is the kind of crap that pisses me off.

Hell, I assisted in an extrication of a person pinned under their car a week or so back.... no gear or anything. They asked me to stay and continue to maintain c-spine (I was first one at the wreck and all responding depts were shorthanded). Everything was fine untill the guy on the other side of the car started cranking away with the hurst tool before taking out the glass. Damn stuff shot right in my face.

I didnt sue though cuz Im not an a$$hole... also Im just as responsible for not having propper PPE.

It could be worse I guess,she could be suing because Mcdonalds served her "hot" coffee.

You guys are acting like a lot of biased spoiled whiney babies. Give the lady the benefit of the doubt. Were any of you there? Did any of you actually feel what she endured? Do you judge everyone w/o all the facts?
